11-2-6: MINOR LAND DIVISION:
In case of redividing or resubdividing a lot or lots in any recorded subdivision into five (5) lots or less, which does not involve new street dedications or easements of access, no roadway construction, and no village utility extensions to serve the proposed resubdivided lots, the developer must proceed through the sketch plan process, may skip the preliminary plan process, and may proceed to the final plat process.
The final plat shall be submitted in the form provided in this title and shall be approved or disapproved by the planning commission and sent on to the village council for final approval in accordance with the applicable final plat provisions in this title. The subdivider shall follow the regulations set forth in this title for final plats, except as it may require action and documentation with respect to subdivision improvements, which improvements, in the case of a minor subdivision, exist and need not be made.
Any division or redivision of land which does not meet the requirements of the minor land division shall fulfill all requirements of the subdivision regulation in order to be approved by the village of Seneca. (Ord. 11-13, 10-4-2011)
