8-3-1: WATER USER CHARGES:
The following rates shall be considered a part of the contract of every person who takes water supplied by the village through the village waterworks system, and every such person who takes water shall be considered as having expressed his agreement to be bound thereby.    A.   Inside Village Limits: Within the corporate limits of the village there are hereby established rates and charges for the use of and for the services supplied by the municipal waterworks system of the village of Seneca, county of LaSalle.
The charge for water service shall be based upon the amount of water consumed each month on each premises supplied with water service by said system as follows:

The charge for senior citizens sixty five (65) years or over shall be:

Provided, however, that the minimum charges shall apply for each apartment, flat, place of business, mobile home, family unit or dwelling unit served by or through each service connection for each month or fraction thereof. (Ord. 09-18, 11-3-2009, eff. 1-1-2010; amd. Ord. 10-04, 3-16-2010)
   B.   Outside Village Limits: Outside the corporate limits of the village there are hereby established rates and charges for the use of and for the services supplied by the municipal waterworks system of the village of Seneca, county of LaSalle.
      1.   Water Service: The charge for water service shall be based upon the amount of water consumed each month on each premises supplied with water service by said system as follows:

Provided, however, that the minimum charges shall apply for each apartment, flat, place of business, mobile home, family dwelling unit served by or through each service connection for each month or fraction thereof.
   C.   Water Hookups: The charge for connection to new or existing water mains, or for reconnection to new or rebuilt water mains, shall be one thousand dollars ($1,000.00), and such connection or reconnection shall only be with the permission of the village.
   D.   Late Charges: Any person (with the exception of taxing bodies and churches) that does not pay any bill or account rendered for water or water service furnished by the village within fifteen (15) days from the date of said bill or account, shall pay a late charge of ten percent (10%) of the amount of said bill.
   E.   Review Of Charges: The adequacy of the water service charge shall be reviewed not less often than annually by certified public accountants for the village in their annual audit report. The water service charge shall be revised periodically to reflect a change in local capital costs or OM&R costs. In addition, there shall be an automatic increase of two percent (2%) of water and sewer rates effective April 1 each year, commencing April 1, 2010.
   F.   Revenues:
      1.   Revenues To Be Separate: All revenues and monies derived from the operation of the water system shall be deposited in the water account of the water fund. All such revenues and monies shall be held by the village treasurer separate and apart from his private fund and separate and apart from all other funds of the village, not more than ten (10) days after receipt of the same or at such more frequent intervals as may be from time to time directed by the president and board of trustees. The village treasurer shall receive all such revenues and all other funds and monies incident to such system as the same may be delivered to him and be deposited the same in the account of the fund designated as the water fund of the village. Said treasurer shall administer such fund in every respect in the manner provided by statute of the revised cities and villages act, effective January 1942.
      2.   Accounts: The village treasurer shall establish a proper system of accounts and shall keep proper books, records and accounts in which complete and correct entries shall be made of all transactions relative to the water system and at regular annual intervals, he shall cause to be made an audit by an independent auditing concern of the books to show the receipts and disbursements of the water system.
      3.   Audit Report: In addition to the customary operating statements, the annual audit report shall also reflect the revenues and operating expenses of the water facilities, including a replacement cost. The financial information to be shown on the audit report shall include the following:
         a.   Flow data showing total gallons received at the water plant for the current fiscal year.
         b.   Billing data to show total number of gallons billed per fiscal year.
         c.   Number of users connected to the system.
         d.   Number of nonmetered users.
   G.   Computation Of Rates And Charges: The method for computation of rates and service charges established for user charges in subsections A and B of this section shall be made available to a user within thirty (30) days of receipt of a written request for such. Any disagreement over the method used, or in the computations thereof, shall be remedied by the village council within sixty (60) days after notification of a formal written appeal outlining the discrepancies.
   H.   Access To Records: The Illinois environmental protection agency or its authorized representatives shall have access to any books, documents, papers and records of the village which are applicable to the village system of user charges for the purpose of making audit, examination, excerpts and transcriptions thereof, to ensure compliance with the terms of the loan agreement and rules for any state loan.
