7-4-5: SANITARY LANDFILLS 1 :
   A.   Definition: As used in this section, "landfill" means any operation or activity which is a "sanitary landfill" within the meaning of the Illinois environmental protection act, 415 Illinois Compiled Statutes 5/1 et seq.
   B.   Landfill Restricted: The placement of a sanitary landfill is hereby prohibited within fifteen thousand feet (15,000') of any water source within the village.
   C.   Violation; Injunctive Relief: Violation of this section is hereby declared to be a public nuisance, enforceable by injunctive relief.
   D.   Cost Of Abatement: In addition to the penalty imposed by this section for the erection, contrivance, creation, continuance or maintenance of a landfill, the cost of abating a public nuisance by the village shall be collected as a debt from the owner, occupant or person causing, permitting or maintaining the nuisance, and if notice to abate the nuisance has been given to the owner, such cost shall be assessed against the real estate as other special taxes.
   E.   Penalty: The owner, occupant or person causing a landfill to be operated, upon conviction thereof, shall be fined not less than four hundred dollars ($400.00) nor more than five hundred dollars ($500.00) for each offense and a separate offense shall be deemed committed on each day during or on which such nuisance is permitted to exist.
