7-1-1: EXCAVATIONS AND RIGHT-OF-WAY IMPROVEMENTS; FEES:
   A.   Permit Required:
      1.   Streets, Alleys And Sidewalks: No street, alley, sidewalk, public property or public right of way shall be cut, trenched, excavated or improved by any person without first having a written permit from the Village. There shall be a twenty dollar ($20.00) fee payable upon filing of the permit application.
      2.   Curbs And Driveways: No curb shall be changed or removed and no driveway on or across a public street or a public right of way or public property shall be repaired or installed without first having a written permit from the Village. There shall be a twenty dollar ($20.00) fee payable upon filing of the permit application.
   B.   Bond Required: Each applicant shall file a bond in the amount of five thousand dollars ($5,000.00) with surety to be approved by the Council for the purpose of indemnifying the Village for any loss or damage resulting from the work undertaken or the manner of doing the same, including any and all repairs needed to place or keep the surface in a condition as it was before the excavation for a period of two (2) years. Repairs shall be made pursuant to the exhibits attached to Ordinance 94-10 on file in the office of the Village Clerk. The bond shall be for a minimum period of two (2) years.
   C.   Penalty: Any person violating any provision of this Section shall be fined not less than fifty dollars ($50.00) nor more than five hundred dollars ($500.00) for each offense, and a separate offense shall be deemed committed on each day during or on which an offense occurs or continues.
