§ 130.03 CURFEW FOR MINORS.
   (A)   No parent, guardian or other custodian of any child between the full ages of 13 years and 18 years shall permit that child to be in a public place in the town:
      (1)   Between 12:01 a.m. and 5:00 a.m. on Saturday or Sunday;
      (2)   After 10:30 p.m. on Sunday, Monday, Tuesday, Wednesday or Thursday; or
      (3)   Before 5:00 a.m. on Monday, Tuesday, Wednesday, Thursday or Friday.
   (B)   No parent, guardian, or other custodian of any child under the age of 13 years shall permit that child to be in a public place in the town after 10:00 p.m. or before 5:30 a.m. on any day.
   (C)   It is a curfew violation for any person 17 years of age or younger to be present in any public street, alley, park or public place in the town from October 15 to November 1 of every year between the hours of 9:00 p.m. to 5:00 a.m. (prevailing time) of the following day.
   (D)   This section does not apply to a child who is accompanied by parent, guardian, custodian or the specified adult nominee of the parent, guardian or custodian, nor does it apply to participation in or returning from lawful employment, lawful athletic event, educational, religious or social event.
   (E)   Each member of the Police Department is directed to take into custody any minor person violating the provisions of division (A) above, and to take the minor person, while in custody, to his or her place of residence and thereupon determine the name of the parent, guardian or other person having the legal custody of the minor person. It shall be the duty of the apprehending officer to cause a citation for violation of this section to be issued to the offending parent, guardian or custodian.
