Unless a special permit to encroach is issued by the Town Council, it is unlawful for any person to:
(A) Construct a parking area within a right-of-way;
(B) Construct a fence within a right-of-way other than a temporary fence required for environmental or construction purposes;
(C) Place any advertising material within a right-of-way; and
(D) Perform any work not listed under § 92.38 of this chapter within a right-of-way without permit.
