§ 90.41 PROHIBITED ACTS; NUISANCE DECLARED; EXEMPTIONS.
   (A)   Prohibited acts. It is unlawful and an offense for any person to park, store or leave, or to permit the storing or leaving, of any junk vehicle of any kind which is in an abandoned, wrecked, dismantled, inoperative, rusted, junked or partially dismantled condition, whether attended or not, upon any private property within the town limits for a period of time in excess of ten days.
   (B)   Nuisance declared. The presence of any junk vehicle or any abandoned, wrecked, dismantled, inoperative, rusted, junked or partially dismantled vehicle or boat or parts thereof on private property is hereby declared a public nuisance which may be abated as such in accordance with the provisions of this subchapter.
   (C)   Exemptions. The provisions of divisions (A) and (B) above shall not apply to any vehicle or motor vehicle enclosed within a building on private property or to any vehicle held in connection with a lawful business enterprise and properly operated as such business enterprise in the appropriate zone, pursuant to the town zoning ordinances, or to any vehicle or motor vehicle in operable condition, or any vehicle retained by the owner in an enclosed storage place maintained in a lawful place and manner, which such enclosure is such that prevents public viewing thereof.
