(a) The creating of any unreasonably loud, disturbing and unnecessary noise in the Municipality is declared to be detrimental to the health, peace and quiet of the inhabitants of the Municipality and is prohibited. The following, among others, are unreasonably loud, disturbing and unnecessary noises in violation of this section, but such enumeration shall not be deemed to be exclusive:
(1) The sounding of any horn or signal device on any motor vehicle, motorcycle, bicycle, or other vehicle while not in motion, except as a danger signal, or while in motion, except as a danger signal or to indicate the change of the rate of speed, or intention to pass a pedestrian or vehicle on the street; in any such case, sounding such horn or signal device for an unnecessary or unreasonable period of time.
(2) The playing of any radio, phonograph or other musical instrument in such manner or with such volume as to annoy the quiet, comfort and repose of a person in any suite, or dwelling outside the one in which such radio, phonograph or other musical instrument is being played, or outside the vehicle if such radio, phonograph or other musical instrument is located in a vehicle.
(3) The keeping of any dog, animal or bird which, by causing frequent or long continued noise, is disturbing the comfort and peace of any person in the immediate vicinity and outside of the suite or dwelling in which such dog, animal or bird is kept.
(4) The operation of any motor vehicle, motorcycle or other vehicle so out of repair or so loaded in such manner as to create loud and unnecessary grating, grinding and rattling and other noise which could be eliminated if such motor vehicle or vehicle were properly repaired or loaded.
(5) The discharge into the open air of the exhaust of any steam engine, safety valve of a boiler or heating plant, stationary internal combustion engine or motor vehicle engine, except through a muffler which will effectively prevent loud and unnecessary noise therefrom.
(6) The erection, including excavating, demolition, alteration or repair of any building, except between the hours of 7:00 a.m. and 6:00 p.m. on week days and except in case of urgent necessity in the interest of public safety, and then only with a permit from the Building Commissioner, which permit may be granted or renewed for a period of three days or less while the emergency continues.
(7) The creation of any excessive noise on any street adjacent to any school, institution of learning or court, while the same is in session, or adjacent to any hospital or sanatorium, which noise unreasonably interferes with the work of such institution, provided conspicuous signs are placed in such streets indicating that the same is a school, hospital, court or sanatorium.
(8) The creation of a loud and excessive noise in connection with the loading or unloading of any vehicle, or the opening or destruction of any bales, boxes, crates and containers.
(9) The shouting, crying, ringing of bells, blowing of horns or whistles by peddlers, hawkers and vendors in such manner as to disturb the peace and quiet of the neighborhood.
(10) The calling out by any person, between the hours of 8:00 p.m. and 8:00 a.m. of any week day, or between the hours of 8:00 p.m. on any Sunday and 8:00 a.m. on any Monday, for the purpose of announcing in a tone of greater than ordinary conversational tone, the sale of any newspapers or merchandise of any kind.
(11) The operation of any gasoline-powered equipment such as snowmobiles, snow blowers, mini-bikes, lawn mowers, etc. within 300 feet of any inhabited dwelling or apartment between the hours of 9:00 p.m. and 7:00 a.m.
(b) Whoever violates this section is guilty of a minor misdemeanor for a first offense and a misdemeanor of the fourth degree for any subsequent violations.
