123.03 EMS FEES.
   (a)   The Municipal Manager is hereby authorized and directed to establish the reasonable and customary fees for EMS services provided and the Municipality is authorized and directed to bill for said services as appropriate, utilizing a third party billing firm as designated by the Manager. In determining the reasonable and customary fees for EMS services, the Municipality may consider such factors to include, but not limited to, the actual cost of equipment, supplies, fuel and compensation (including benefits) of employees and the depreciation of building structures as well as the cost to maintain, operate and improve said building structures. The Manager will present to Council from time to time the fee schedule established as the reasonable and customary fees for EMS services. The EMS Fee Schedule shall be effective retroactively to August 1, 2009.
   (b)   The EMS Fee Schedule may be amended from time to time by the Manager and submitted to the Council. In the event that there is any dispute regarding whether the fees which may apply, Council shall have the ultimate authority to determine the applicability and amount of the fees charged under any circumstance.
