1309.99 PENALTY.

(a) Whoever violates any provision of Section 1309.01 is guilty of a minor misdemeanor. When any person is found guilty of a subsequent offense, such person is guilty of a misdemeanor of the fourth degree. Any person found guilty of third or subsequent offense shall be fined the maximum allowed by law and such fine is mandatory and shall not be remitted.

(b) Whoever violates any provision of Section 1309.02 is guilty of a first degree misdemeanor.
