533.15 SEX OFFENDERS PROHIBITED IN VILLAGE CONTROLLED LANDS.
   (a)   Any membership or request for use of facilities, in the Village of Sebring shall be denied, or if already issued, rescinded, and the membership fee, application/rental fee, refunded, for any individual who, pursuant to Ohio Revised Code Chapter 2950, has a duty to register in Ohio, or who appears, or should appear, on the National Sex Offender Registry. Any required application for membership or use of facilities shall include the inquiry about whether the applicant, or if applying for a two-person or family membership, any family member of the applicant, is an individual presently required to register as a sex offender. The Village of Sebring Parks & Recreation Department shall examine the membership applications for all individuals applying for and holding memberships at any recreation facilities; or requesting use/rental of Village recreational facilities, to determine whether such individuals are mandated to register as sex offenders in the state of Ohio. In such event, the Village Parks and Recreation Department shall inform the individual that the application/request is denied or rescinded as to any family who is required to register as a sex offender, and any prorated fees for such application/request shall be refunded to such individual by the Parks and Recreation Department. The Parks Director or the designee of the Parks Director, shall adopt reasonable rules to calculate the amount of refund owed to such individual in the event that such individual is a member of a family or other multiple individual membership at any Village Recreation Facilities. This ban applies to all individuals who request guest passes to Village Recreation Facilities as well as annual memberships. No Registered Offender shall enter or remain upon any recreation facilities or Village property except, and only to the extent necessary, to attend meetings of the public bodies.
   (b)   Definitions. As used in this section, words and phrases set forth shall have the following meanings:
      (1)   “Registered offender” mean any person who is required to register pursuant to the terms of Ohio R.C. 2950.04 through 2950.06, as the same may be amended from time to time, regardless of whether that person is on parole or probation, and has been convicted of the offense against a child.
      (2)   “Recreational Facilities” means all land and buildings owned or controlled by the Village of Sebring and used for park or recreation purposes, including, but not limited to the Village Community Center, and all parks, playgrounds, athletic field and pavilions.
      (3)   “Public Body” has the same meaning as found in Ohio Revised Code 121.22.
   (c)   Whoever violates this section shall be guilty of criminal trespass as provided in the Codified Ordinances of the Village of Sebring Section 541.05 or Ohio Revised Code Section 2911.21.
