As used in this chapter:
(a) “Division of Stormwater Management Utility”. There shall be a division of stormwater management utility, within the Village of Sebring, which shall be responsible for developing and implementing stormwater management plans and solely managing facilities, stormwater systems and stormwater sewers. This division shall charge a Stormwater User Fee based on individual contribution of runoff as determined by property classification to the system benefits enjoyed and service received. The division of stormwater management utility shall be administered by the Village Manager. The Village Manager shall serve as the principal executive officer for the storm water management utility for the purposes of fulfilling the requirements of the Environmental Protection Agency's NPDES Phase II stormwater program. The Village Manager is authorized to proceed towards implementation of a stormwater management utility and formal commencement of operations including implementation and collection of the Stormwater User Fee on or about January 1, 2006.
(b) “Director”. The Director of the Stormwater Management Utility shall be the Village Manager.
(c) “Stormwater System” means all manmade facilities, structures, and natural water courses used for collecting and conducting stormwater to, through and from drainage areas to the points of final outlet including, but not limited to, any and all of ditches, streams, gulches, gullies, flumes, culverts, siphons, street, curbs, gutters, dams, floodwalls, levees and pumping stations.
