933.12 ADDITIONAL SURCHARGE FOR INDUSTRIAL WASTES.
   (a)   Any person, firm or corporation served by a sewer connection which discharges sanitary sewage, industrial wastes, water or other liquids into the wastewater treatment system, which are of unusual strength, volume or character, but acceptable by the Village for treatment, shall be subject to an additional surcharge which shall be over and above the rates and charges established by the Municipality, as may be amended from time to time.
   (b)   The surcharge shall be effective if any or all of the following are exceeded:
      (1)   BOD greater than 200 mg/l
      (2)   Suspended Solids greater than 200 mg/l
      (3)   Ammonia greater than 25 mg/l
      (4)   Oil/Grease greater than 50 mg/l
   (c)   The surcharge shall be calculated and billed quarterly based on the results of tests and measurements:
 
(1)   BOD in excess of 200 mg/l
$0.30/Lb. of BOD
(2)   Suspended Solids in excess of 200 mg/l
$0.30/Lb. of Suspended Solids
(3)   Ammonia in excess of 25 mg/l
$0.30/Lb. of Ammonia
(4)   Oil/Grease in excess of 50 mg/l
$0.30/Lb. of Oil/Grease
   (d)   The strength of the wastes shall be determined from samples taken at any period or time and of such duration and in such manner as agreed upon between the owner and the Village. The results of routine sampling and analysis by the owner may also be used, in determining the amount of the surcharge after verification by the Village. The strength so found by analysis shall be used in determining the amount of the surcharge. In the event that the Village and the owner cannot mutually agree upon sample time periods and durations, the Village shall establish sample time periods and durations from time to time as it deems necessary and proper, in its sole discretion.
   (e)   In no case shall any person, firm or corporation served by a sewer connection discharge into the sewer system in excess of the following limits:
      (1)   400 Lbs/day of BOD
      (2)   400 Lbs/day of Suspended Solids
      (3)   50 Lbs/day of Ammonia
      (4)   100 Lbs/day of Oil/Grease
   (f)   Any violation of this section will be considered a violation of the Regulations of the Division of Water and Sewer, Department of Public Service of the Municipality of Sebring, Ohio as may be amended from time to time. The Municipality of Sebring, Ohio reserved the right to terminate sewer service, maintain legal action for collection of outstanding amounts due, seek injunctive and declaratory relief and any and all legal or equitable relief available.
