932.01 DEFINITIONS.
   (a)   Specific Definitions. Unless the context of usage indicates otherwise, the meaning of specific terms in this chapter shall be as follows:
      (1)   “Act” means the Federal Clean Water Act, as amended.
      (2)   “ASTM” means the American Society for Testing and Materials.
      (3)   “BOD (denoting biochemical oxygen demand)” means the quantity of oxygen used in the biochemical oxidation of organic matter under standard laboratory procedure in five days at 20 degrees C, expressed in milligrams per liter.
      (4)   “Building sewer” means the extension from a building wastewater plumbing facility to the public wastewater facility.
      (5)   “Combined sewer” means a sewer intended to receive both wastewater and storm or surface water.
      (6)   “Commercial user” (Class II) includes any property occupied by a nonresidential establishment not within the definition of an “Industrial User - Class III”, and which is connected to the wastewater facilities.
      (7)   “Day” means the twenty-four hour period beginning at 12:01 a.m.
      (8)   “Debt service” means the payment requirements to retire the wastewater treatment plant debt (including principal and interest) over the term of the debt obligation.
      (9)   “Easement” means an acquired legal right for the specific use of land owned by others.
      (10)   "EPA" means the United States Environmental Protection Agency.
      (11)   "Garbage" means the solid animal and vegetable wastes resulting from the domestic or commercial handling, storage, dispensing, preparation, cooking and serving of foods.
      (12)   "Governmental uses" means buildings owned by the City of Sebring.
      (13)   "Groundwater" means water within the earth.
      (14)   "Industrial user (Class III)" means any nonresidential user identified in Division A, B, D, E or I of the Standard Industrial Classification Manual. Class III shall also include any user which discharges wastewater containing toxic or poisonous substances, or any substance(s) which cause(s) interference in the wastewater facilities.
      (15)   "Institutional uses" means schools and churches.
      (16)   "Interference" means inhibition or disruption of any sewer system, wastewater treatment process, sludge disposal system, or their operation, which substantially contributes to a violation of applicable discharge permits.
      (17)   "Manager" means the Manager of the City's wastewater system or an authorized designee.
      (18)   "May" is permissible, "shall" is mandatory.
      (19)   "Natural outlet" means any outlet into a watercourse, pond, ditch, lake or any other body of surface or groundwater.
      (20)   "NPDES" means National Pollutant Discharge Elimination System permit program, whether administered by the EPA or by the State of Ohio.
      (21)   “Operation and maintenance” means the process and act of keeping all facilities used for the collecting, pumping, treating and disposing of sewage in a good state of repair and functioning properly, including the replacement of such facilities when necessary.
      (22)   "Owner" means the person or persons who legally own, lease or occupy private property with wastewater facilities which discharge, or will discharge to the City's wastewater facilities.
      (23)   "Person" means any individual, firm, company, association, society, partnership, corporation, municipality or other similar organization, agency or group.
      (24)   "pH" means the logarithm of the reciprocal of the hydrogen concentration expressed in grams per liter of solution as determined by Standard Methods.
      (25)   "Pretreatment" means the reduction of the amount of pollutants, the elimination of pollutants, or the alteration of the nature of pollutant properties in wastewater prior to discharge to the City wastewater facilities.
      (26)   "Pretreatment standard" means any regulation containing pollutant discharge limits promulgated by the EPA in accordance with Section 307(b) and (c) of the Act, which applies to industrial users.
      (27)   "Properly shredded garbage" means garbage that has been shredded to such a degree that all particles will be carried freely under flow conditions normally prevailing in the wastewater sewers, with no particle greater than one-half inch in any dimension.
      (28)   "Replacement cost" means the expenditures for purchasing and installing equipment, accessories or appurtenances which are essential during the useful life of the wastewater treatment plant to maintain the capacity and performance for which the plant was originally designed and constructed.
      (29)   “Residential user” (Class I) means all premises used only for human residency and which is connected to the wastewater facilities.
      (30)   "Sanitary wastewater" means wastewater discharges from the sanitary conveniences of dwellings, office buildings, industrial plants or institutions.
      (31)   "Shall" is mandatory, "may" is permissible.
      (32)   "Standard Methods" means the latest edition of Standard Methods for the Examination of Water and Wastewater, published by the American Public Health Association, Water Pollution Control Federation and American Water Works Association.
      (33)   "State" means the State of Ohio.
      (34)   "Storm sewer" means a sewer for conveying storm, surface and other waters, which is not intended to be transported to a treatment facility.
      (35)   "Surface water" means water which occurs when the rate of precipitation exceeds the rate at which water may infiltrate into the soil.
      (36)   “Suspended solids” means the total suspended matter that either floats on the surface of, or is in suspension in, water or wastewater, as determined by Standard Methods.
      (37)   "Toxic" means any of the pollutants designated by Federal regulations pursuant to Section 307(a)(1) of the Act.
      (38)   "Wastewater" means a combination of liquid and water-carried wastes from residences, commercial buildings, industries and institutions, together with any groundwater, surface water or storm water that may be present.
      (39)   "Wastewater sewer" means the structures, processes, equipment and arrangements necessary to collect and transport wastewaters to the treatment facility.
      (40)   "Wastewater treatment facility" means the structures, processes, equipment and arrangements necessary to treat and discharge wastewaters.
      (41)   "WPCF" means the Water Pollution Control Federation.
   (b)    General Definitions.
