§ 56.06 GARBAGE, RUBBISH, DEPOSITING AND BURNING PROHIBITIONS.
   (A)   No person shall bury or burn any garbage, or deposit garbage or rubbish upon any public way or upon any property owned by another, or in any body of water within the village; nor shall any person deposit or place any garbage upon any premises owned or occupied by him or her unless the garbage is enclosed in a suitable container, as herein required.
   (B)   No hazardous waste, building materials, rubbish, including leaves and brush shall be burned within the village during any season of the year without the approval of the Village Council.
   (C)   It shall be unlawful for any person to do any burning within the village. However, recreational burning is allowed with the following restrictions:
      (1)   Recreational burning is allowed on private property in an enclosed fire burner, as long as the fire does not endanger other buildings or structures, atmospheric conditions are favorable, and only clean wood products or commercially produced fuel products are burned.
      (2)   Recreational burning is allowed on private property, with the exception of emission of smoke or fumes that irritate, annoy, or constitute a nuisance to others living in the neighborhood.
      (3)   Open burning within an outside grill or barbecue for the expressly limited purpose of food preparation is allowed.
      (4)   Open burning of bonfires for recreational purposes only are allowed, provided that any such bonfire shall be no more than four feet in diameter and shall be at least 20 feet from all property lines and structures. All bonfires shall be under the direct and constant supervision and control of a person at least 18 years or older.
