§ 21-1-47 SAME; LAWFUL CONVEYANCE DUE TO CONSTRUCTION PROBLEMS.
   A proposed subdivision may be approved without a plat thereof if the subdivision is for the purpose of making lawful the conveyance of a part of lot, block, or tract of land which would otherwise be or was accomplished in violation of § 21-1-42 of this subchapter, either in the original form of such section or as amended from time to time, where the acquisition or conveyance of such part of a lot, block, or tract of land was made necessary by problems arising in the construction of a building on adjoining property and where the City Council finds that the problems arising in the construction of the building could not reasonably have been anticipated before commencement of construction.
