§ 20-7-34 TREE; CUTTING DOWN AND INJURING.
   It shall be unlawful for any person to willfully, maliciously, or wantonly cut down, destroy, or injure by girdling, tapping, topping, improper pruning, or otherwise, any street tree within the city, except in compliance with the requirements of this article. Provided, that damage caused to a street tree as a result of the city’s exercise of any of its rights to the street right-of-way shall not be considered a violation of this section. In addition, the city shall have no liability for damage to trees incurred as a result of the exercise of these rights.
