If materials from an excavation that are not to be used in backfilling and repair are not removed from the street, alley, or public place immediately; or if the excavation is left open or unfinished for a period of more than 24 hours after completion of the work that required the excavation; or if the work shall have been improperly done; or should settling occur and the holder of the permit fail to place the street, alley, or public places in a smooth condition at any time during the six months’ period after completion of the original backfilling, the city may do the work and charge the expense thereof to the person to whom the permit was issued. If the work was in connection with the laying or repair of water service pipes, and is done by the city prior to turning on the water, the expense shall be paid by the holder of the permit, or by the consumer, before the water is turned on.
