Any person operating skates or a skateboard upon a public sidewalk or within a park shall yield the right-of-way to pedestrians, shall announce his or her presence before passing a pedestrian, and shall exercise due care when passing a pedestrian. Any person operating skates or a skateboard upon a public sidewalk or within a park when involved in a collision with a pedestrian, shall be rebuttably presumed to have been negligent.
