§ 13-2-9 ENTRY AND REMAINING ON PROPERTY; WHEN PROHIBITED.
   (A)   It shall be unlawful for any person, if he or she knows that he or she is not licensed or privileged to do so:
      (1)   To enter or secretly remain in any building or occupied structure, or any separately secured or occupied portion thereof; or
      (2)   To enter or remain in any place as to which notice against trespass is given by actual communication to the actor; posting in a manner prescribed by law or reasonably likely to come to the attention of intruders; or fencing or other enclosure manifestly designed to exclude intruders. Provided, it is an affirmative defense to prosecution under division (A)(1) above that the building or occupied structure was abandoned, and to a prosecution under either this division (B)(2) or division (A)(1) above that the premises were at the time open to members of the public, and the actor complied with all lawful conditions imposed on access to or remaining in the premises, or that the actor reasonably believed that the owner of the premises or other person empowered to license access thereto would have licensed him or her to enter or remain.
   (B)   A violation of any provision of this section is a Class I violation.
