§ 25-2-41 FAMILY CHILD CARE HOME.
   FAMILY CHILD CARE HOME. A place where care is provided:
      (1)   To four or more, but not exceeding 12, children under age 13 at any one time from families other than that of the provider;
      (2)   For on the average of less than 12 hours per day;
      (3)   For compensation, either direct or indirect;
      (4)   On a regular basis;
      (5)   By a person other than their parents or guardians;
      (6)   In the home of the person providing the care; and
      (7)   In full compliance with all the applicable laws and regulations of the state pertaining to child care, whether such laws and regulations exist at the time of the passage of this chapter or are hereafter adopted.
