(A) A Board of Adjustment is hereby re-established and continued. The Board of Adjustment shall consist of five members: four from the town and one from the extraterritorial area. All members of the Board shall have voting power on all matters of business. The town resident members shall be appointed by the Town Board; the resident from the extraterritorial area shall be appointed by the Board of Commissioners of the county. If the Board of County Commissioners fails to appoint the extraterritorial member within 90 days after receiving resolution from the Town Board of Commissioners requesting that these appointments be made, the Town Board of Commissioners may make them.
(B) The members of the Board will serve staggered terms of three years each. Board of Adjustment terms in effect when this chapter is adopted (November 1988) shall continue, and members serving when this chapter is adopted shall continue without reappointment.
(C) The initial membership was appointed as follows: one member for one year; two members for two years; and two members for three years.
(D) Town members of the Board may be removed by action of the Town Board of Commissioners; extraterritorial members by the County Board of Commissioners. Removal may be for inefficiency, neglect of duty or malfeasance in office, and such removal may only come after a public hearing concerning the action to be held.
