§ 152.140  EFFECT OF DENIAL.
   Once a proposed change to the Zoning Code or Zoning Map, or special use district is denied by the Town Board, said proposal may not be resubmitted within a period of two years from the date of denial by the Town Board unless the Town Board shall first determine in a separate and subsequent resolution that the circumstances related to a determination of the proper zoning for a specific area have so substantially changed from the date of the Town Board’s previous consideration that a petition for rezoning should be accepted, in which case it will be treated as a new proposal and application.
