§ 152.139  SPECIAL USE PERMIT REQUESTS AS PART OF CHANGE TO SPECIAL USE DISTRICT.
   Request for special use permits as part of a requested change to a special use district shall be processed and considered simultaneously with the zoning map change requests for the special use district, and the voting procedure shall be the same as that required for zoning map change requests. Procedures shall be specified in this subchapter. In considering such application for a special use permit, the town shall find that the conditions in § 152.061 will be met. If the Town Board should find, after the hearing, that the proposed special use permit should be granted, the Board may authorize the issuance of such permit. If the Town Board should find, after the hearing, that the proposed special permit should not be granted, such proposed permit shall be denied. In granting a special use permit, the Town Board may impose such reasonable and appropriate special requirements upon such permit as it may deem necessary in order that the purpose and intent of this chapter is served, public welfare secured and substantial justice done. If all requirements and conditions are accepted by the applicant, the Town Board shall authorize the issuance of the special use permit; otherwise, the permit shall be denied. Any special use permit so authorized shall be perpetually binding upon the property included in such permit unless subsequently changed or amended by the Town Board after a public hearing by the procedures in this section.
