§ 113.1909 NOTIFICATION OF CHANGES IN RATES, PROGRAMMING, OR CHANNEL LOSITIONS
   In accordance with FCC regulations as stated in 47 U.S.C. § 76.309, Grantee shall notify Subscribers of any changes in rates, programming services or Channel positions as soon as possible through announcements on the Cable System and in writing. Notice must be given to Subscribers (including the Franchising Authority) a minimum of thirty (30) days in advance of such changes if the change is within the control of the Cable Operator. In addition, the Cable Operator shall notify the Subscribers (including the Franchising Authority) thirty (30) days in advance of any significant changes in the other information required in Section 113.1802. Notwithstanding any other provision of Title 47 U.S.C. Part 76, a Cable Operator shall not be required to provide prior notice of any rate change that is the result of a regulatory fee, Franchise Fee, or any other fee, tax, assessment, or charge of any kind imposed by any Federal agency, state, or the Franchising Authority on the transaction between the Cable Operator and the Subscriber.
