§ 113.1001 AMOUNT, PAYMENT AND REQUIRED INFORMATION
   (A)   Unless otherwise permitted in a Franchise Agreement, during the term of each Franchise, Grantee shall pay to Village an amount equal to the maximum percent per year of Grantee's annual Gross Revenues permitted by law. To the extent permitted by law, and in accordance therewith, increases in Franchise Fees may be levied by the Village after sixty (60) days from the passage of an ordinance so doing.
   (B)   Each Grantee shall make and the Village shall receive bi-monthly (by the last day of every other month, starting with the end of February), a Franchise Fee payment which represents 1/6 of the total amount of Franchise Fees paid for the preceding calendar year. Once annually, by March 31, each Grantee shall pay to the Village and any difference between the amount paid bi-monthly and the amount equal to five percent (5%) of the actual Gross Revenues for the calendar year that has just ended, should any difference exist. At that time, when the actual Gross Revenues for the preceding calendar year are calculated, any necessary upward adjustment in the 1/6 payment shall begin with the next payment. Conversely, if after making its Franchise Fee calculation, the Grantee finds that it has overpaid the Village, the amount overpaid shall be credited to the Grantee and be deducted from the regularly scheduled payment.
   (C)   The Grantee shall file by March 31 of each year, a written statement signed by the Grantee's Comptroller or other employee authorized by the Grantee to make said representations to the Village and who is knowledgeable of the accuracy of the figures used in the computation and the corresponding payment to the Village.
   (D)    Unless otherwise specified by a Franchise Agreement, such sources and amounts indicated in the statement referenced in Section 113.1001(C) hereinabove shall include, but not be limited to, the following items:
      (1)   Revenues from Basic Services
      (2)   Revenues from expanded Basic Services
      (3)   Revenues from Interactive, Pay-Per-View and Video-on-Demand services
      (4)   Revenues from Internet access or other data services
      (5)   Revenues from Premium Channel services
      (6)   Revenues from Installations, disconnections, trip charges and other repair services
      (7)   Revenues from Converter boxes, remote control units, and other related equipment
      (8)   Revenues from advertising sources and published materials
      (9)   Revenues from Home Shopping Channels
      (10)   Revenues from specific service tiers
      (11)   Revenues from Leased Access Channels, studio and studio equipment rentals
      (12)   Credits for bad debts and refunds
   (E)   Unless otherwise agreed to in a Franchise Agreement, the statement shall include information regarding the number of Subscribers on each service tier, the rate charged for each tier, the number of total Subscribers, the total number of newly connected Subscribers, and the total number of disconnected Subscribers.
