§ 71.20 PARKING ON PUBLIC PROPERTY.
   (A)   It shall be unlawful for any person to park a vehicle upon any property owned by the Village, except where the parking is permitted by ordinance. Parking of a motor vehicle shall be permitted in the municipal parking lot east of the Village Hall at 9526 West Irving Park Road for the time limits specified on signs located throughout portions of the municipal parking lot.
   (B)   Parking of a motor vehicle shall be permitted on that portion of the parkway owned by the Village located on the west side of Foster Avenue from the north edge of Lawrence Avenue on the south to a point 285 feet north thereof.
   (C)   Parking of a motor vehicle shall be permitted on that portion of the parkway owned by the Village, located on the north side of Belle Plaine Avenue from the west edge of George Place on the east to a point 417 feet west thereof.
   (D)   There are established hereby and made available to the persons set forth herein a maximum of 16 “U —Commercial Parking Permits.”
      (1)   In the event any one of the 16 authorized “U —Commercial Parking Permits” is available, upon the payment of $.50 per year by any owner of any commercial or industrial building upon property located immediately adjacent to and east of the easterlymost 20 foot portion of the alley east of and parallel to Prairie Avenue between a point north of the north line of Soreng Avenue and a point 160 feet north of the north line of Soreng Avenue in the Village of Schiller Park, the person making such payment shall receive one “U —Commercial Parking Permit” decal.
      (2)   When such decal is properly displayed in the lower driver's side corner of the windshield of any automobile or light truck, the parking of such vehicle between the hours of 6:00 a.m. and 6:00 p.m. weekdays in any one of the 16 automobile parking spaces reserved for “U —Permit” parking shall be permitted (without any further payment) upon the right of way described as the easterlymost 20 foot portion of the alley east of and parallel to Prairie Avenue between a point north of the north line of Soreng Avenue and a point 160 feet north of the north line of Soreng Avenue in the Village of Schiller Park.
   (E)   Metra Station Commuter Parking Lot.
      (1)   Unless such person has arranged for payment to the Village as set forth in this subsection (E), it shall be unlawful for any person to park a
motor vehicle in the Metra Station Commuter Parking Lot.
      (2)   The Village Manager/Comptroller is authorized to establish regulations for the use of the Metra Station Commuter Parking Lot and to enforce those regulations through the posting of appropriate signs, patrol of such Lot by the Police Department and other actions incidental to such enforcement.
         (a)   The Village Manager/Comptroller is authorized to:
            1.   Limit the period of time a vehicle may park in designated areas;
            2.    Designate areas for daily and/or monthly parking and cause the installation of payment machines in convenient locations in those areas for the collection of fees established in this subsection (E);
            3.   Issue prepaid payment cards for use in payment machines pursuant to the provisions established in this subsection (E);
            4.    Designate areas restricted to the use of handicapped persons;
            5.   Restrict parking in designated areas to those persons holding Overnight/Weekend/Monthly Permit Parking Passes and issue such Overnight/Weekend/Monthly Permit Parking Passes pursuant to the provisions established in this subsection (E);
            6.    Establish speed limits within the Metra Station Commuter Parking Lot;
            7.    Establish "No Parking" zones within the Metra Station Commuter Parking Lot;
            8.   Prohibit use of the Metra Station Commuter Parking Lot for roller-skating, skateboarding or other non-vehicular use that presents a danger to the use of the Lot for parking of motor vehicles or to the persons engaged in such unpermitted use;
            9.    Establish such other regulations as may be required to promote the safe and efficient operation of the Metra Station Commuter Parking Lot.
         (b)   In furtherance of the foregoing, persons parking a motor vehicle in spaces numbered 1 through 102 at the Metra Station Commuter Parking Lot shall pay the amount of $1.50 per parking space per day, Monday through Friday, per 21-hour period (5:00 a.m. through 2:00 a.m. the following day), by using a prepayment card or depositing sufficient United States currency amounting to $1.50 in a payment machine located adjacent to the Metra Station structure.
            1.   There shall be no charge for 21-hour parking between the hours of 5:00 a.m. any given day and 2:00 a.m. the next day in said spaces on Saturdays and Sundays.
            2.   The Metra Station Commuter Parking Lot shall be closed between the hours of 2:00 a.m. and 5:00 a.m. daily.
         (c)   In connection with Overnight/Weekend/Monthly Permit Parking Passes.
            1.   The Village Manager/Comptroller shall cause suitable Overnight/Weekend Permit Parking Passes to be prepared and made available for sale to persons desiring to park in those portions of the parking facilities in which parking is restricted to holders of such passes. The number of Overnight/Weekend Permit Parking Passes issued shall not exceed nine of the parking spaces actually available for parking, unless the Village Manager/Comptroller determines, on the basis of surveys of parking space vacancy rates and other relevant criteria, that the sale of an additional number of passes is justified, in which event, an additional number of passes may be sold at the direction of the Village Manager/Comptroller. Overnight or Weekend or Monthly Permit Parking Passes shall be sold for monthly periods as provided below.
            2.   The Village Manager/Comptroller shall cause suitable Monthly Permit Parking Passes to be prepared and made available for sale to persons desiring to park in spaces numbered 1 through 102 at the Metra Station Commuter Parking Lot.
               A.    Monthly Permit Parking Pass holders must remove their vehicles from the lot between the hours of 2:00 a.m. and 5:00 a.m. daily, as the lot is and will be closed during those hours to all vehicles not displaying Overnight/Weekend Permit Parking Passes and parked within the designated spots numbered 103 through 111.
               B.    Monthly Permit Parking Pass does not permit the holder Overnight/Weekend Parking. A separate Overnight/Weekend Permit Parking Pass shall be purchased in addition to the Monthly Permit Parking Pass if twenty-four (24) hour parking is desired.
               C.   A Monthly Permit Parking Pass may be obtained by submitting an application to the Village Clerk, containing the name, address and telephone numbers of the owner of the vehicle, and a description of the vehicle (make, model, color, and license plate number); and
               D.    Paying a non-refundable amount equal to $30 per month. Monthly Permit Parking Passes may be purchased monthly or in advance for any number of months for up to 12.
            3.   Under the direction of the Village Manager/Comptroller, Overnight/Weekend/Monthly Permit Parking Passes shall be sold during regular business hours at the Village offices and shall be sold in accordance with chronological priority of application for such passes, except that the Village Manager/Comptroller may establish a schedule for sale only to persons residing within the corporate limits of the Village or persons who own or are employed by businesses within the corporate limits.
            4.   The Village Manager/Comptroller is authorized to refuse to issue an Overnight/Weekend/Monthly Permit Parking Pass to any person who has committed three or more violations of the provisions of subsection (E)(3) below.
            5.   Persons parking a motor vehicle in parking spaces numbered 103 through 111 shall first secure a monthly Overnight/Weekend Permit Parking Pass for 24-hour parking from the Village by:
               A.    Submitting an application to the Village Clerk, containing the name, address and telephone numbers of the owner of the vehicle, and a description of the vehicle (make, model, color, and license plate number); and
               B.    Paying a non-refundable amount equal to $30 per month. Overnight/Weekend Permit Parking Passes may be purchased monthly or in advance for any number of months for up to 12.
            6.    Overnight/Weekend/Monthly Permit Parking Passes shall be clearly displayed in the rear window of such vehicle so permitted to park.
      (3)   It shall be unlawful for any person:
         (a)   To back into any parking space.
         (b)   To park or let stand any vehicle across or upon any marking designating a parking space.
         (c)   To park or let stand any vehicle that does not bear a 24-hour Overnight/Weekend/Monthly Permit Parking Pass, issued in accordance with this subsection (E).
         (d)   To park or let stand any vehicle in any parking space in violation of restrictions posted on signs in the area, including restrictions concerning the following:
            1.   The maximum consecutive time period that a vehicle may occupy a parking space;
            2.   The hours of the day during which parking is allowed;
            3.   The requirement for an Overnight/Weekend Permit Parking Pass displayed on a vehicle parked in the space.
         (e)   To park or let stand any vehicle in any area marked "No Parking" or in any other manner that will interfere with traffic into, through or out of the Metra Station Commuter Parking Lot.
         (f)   To park or let stand any vehicle in any parking space available for daily use without depositing the fee established by this subsection (E) in the payment machine and correctly entering the parking space number for such parking space.
         (g)   To alter, deface or counterfeit any Overnight/Weekend or Monthly Permit Parking Pass issued by the Village.
         (h)   To deposit or attempt to deposit in any payment machine any slug, button or other device or substance as a substitute for coins of United States currency.
            1.    [Intentionally omitted.]
            2.   To deface, injure, tamper with, open or willfully break, destroy or impair the usefulness of any payment machine.
      (4)   Definitions. As used in this subsection (E), the following words shall have the meanings ascribed to them in this paragraph, except where the context clearly indicates a different meaning:
         (a)   OVERNIGHT OR WEEKEND OR MONTHLY PERMIT PARKING PASS. A 24-hour Overnight or Weekend or Monthly Permit Parking Pass, issued by the Village for a fee, which shall be established from time to time by the President and Board of Trustees, allowing the holder thereof to park in designated areas located within the Metra Station Commuter Parking Lot.
         (b)   METRA STATION COMMUTER PARKING LOT. That property commonly located at 4555 Ruby Street, Schiller Park, Illinois.
      (5)   Improperly parked and abandoned vehicles; penalties.
         (a)   Any person who violates the provisions of this subsection (E) shall be fined not less than $20 for each offense. Each day that a violation occurs or continues shall be a separate offense.
         (b)   In addition to the monetary fines provided in this subsection (E), and provided proper signs are posted, the Chief of Police may authorize immediate removal of the vehicle by a towing service, at the sole cost and expense of the owner of such vehicle.
         (c)   The Village shall not be liable for any damage to any vehicle which occurs as a result of the towing and storage of any vehicle under the provisions of this subsection (E).
         (d)   Any vehicle determined to be abandoned and parked in violation of this division shall be subject to the provisions contained in Chapter 90 of this Code.
