§ 150.006 PROPERTY MAINTENANCE CODE, AMENDMENTS ADOPTED.
   (A)   The 2021 edition of the International Property Maintenance Code published by the International Code Council is adopted, one copy of which will be retained on file in the Office of the Village Clerk. This code is hereby identified as the 2021 International Property Maintenance Code or the 2021 IMPC.
   (B)   The 2021 International Property Maintenance Code is amended herein as follows:
      (1)   The words "Village of Schiller Park" shall be inserted wherever the words "(name of jurisdiction)" or "(insert name of department)" appears.
      (2)   As used throughout the Code adopted by reference hereby, the "code official" shall mean and include the "Building Official" and/or the "Director of Community Development" of the Village of Schiller Park.
      (3)   Sections 103.2, and 103.3, are amended in their entireties; so that hereafter the said Sections 103.2 and 103.3 shall be and read as follows:
      "103.2 Code official: The Building Inspector and/or the Director of Community Development of the Village of Schiller Park (including their authorized agents and representatives).
      103.3 Deputy code official: Collectively, all of the duly authorized agents and representatives of the Code Official who shall have and exercise all powers of the Code Official during the temporary absence or disability of the Code Official."
      (4)   Section 104.1 is amended hereby in its entirety; so that hereafter the said Section 104.1 shall be and read as follows:
      "104.1 Fees. The fees for activities and services performed by the Department in carrying out its responsibilities under this code shall be $50 per hour."
      (5)   Section 104.2 is amended hereby in its entirety; so that hereafter the said Section 104.2 shall be and read as follows:
      104.2 Refunds. Refunds are granted through a procedure in place approved and ratified by the Village of Schiller Park Board.
      (6)   The first paragraph of Section 302.4, is amended in its entirety; so that hereafter the said first paragraph of Section 302.4 shall be and read as follows:
      "302.4 Weeds. All premises and exterior property shall be maintained free from weeds or plant growth in excess of eight (8) inches. All noxious weeds shall be prohibited. Weeds shall be defined as all grasses, annual plants and vegetation, other than trees or shrubs provided; however, this term shall not include cultivated flowers and gardens."
      (7)   Section 304.14 is amended in its entirety hereby; so that hereafter Section 304.14 shall be and read as follows:
      "304.14. Insect screens. During the period from May 1st to October 15th, every door, window and other outside opening required for ventilation of habitable rooms, food preparation areas, food service areas or an areas where products to be included or utilized in food for human consumption are processed, manufactured, packaged or stored shall be supplied with approved tightly fitting screens of not less than 16 mesh per inch (16 mesh per 25 mm), and every screen door used for insect control shall have a self-closing device in good working condition."
      Exception: Screens shall not be required where other approved means, such as air curtains or insect repellent fans, are employed.
      (8)   Chapter 3 is amended hereby to include an additional section, Section 310; so that hereafter the said Section 310 contained in Chapter 3 shall be and read as follows:
   "SECTION 310
   AIR POLLUTION
      310.1 Air pollution: It shall be unlawful for any person to cause or permit the emission of air pollutants or airborne contaminates which, in the opinion of the Code Official, endangers the health and safety of the public."
      310.2 Definition of Air Pollution. Airborne contaminates or vapors that are harmful to the health of humans or other living beings according to the United States Environmental Protection Agency and Occupational Safety and Health Administration, Illinois Department of Public Health, and any local agency regulating health and safety.
      310.3 Fines. Fines associated with the illicit discharge or emission of airborne contaminants or air pollution shall be according to fees and penalties set by the Village of Schiller Park Board.
      (9)   Section 402 is amended hereby to include an additional section, Section 402.4, entitled "Adjacent or adjoining lots"; so that hereafter the said Section 402 shall contain Section 402.4 which shall be and read as follows:
      "402.4 Adjacent lots. No light from one lot (adjacent) shall spill over onto an adjacent lots. A photometric light diagram shall be submitted by the owner of the property emitting the light, when this condition exists, showing the extent of the lighting spill over. This shall be approved or disapproved by the Code Official.
      For purposes of this Section the word "adjacent" shall mean touching, lying immediately next to, abutting and/or sharing a common wall or lot line."
      (10)   Section 404.5 is amended in its entirety; so that hereafter the said Section 404.5 shall be and read as follows:
      "404.5 Overcrowding. Dwelling units shall not be occupied by more occupants than permitted by the requirements set forth below:
   1.   The minimum square footage for a room to be considered a bedroom should be 100 square feet.
   2.   Children 12 and under count as ½ person for occupancy.

      (11)   The first paragraph contained in Section 602.3 is amended in its entirety hereby; so that hereafter the said first paragraph contained in Section 602.3 shall be and read as follows:
      "602.3 Heat supply. Every owner and operator of any building who rents, leases or lets one or more dwelling units or sleeping units on terms, either expressed or implied, to furnish heat to the occupants thereof shall supply heat during the period from September 15th to May 1 to maintain a temperature of not less than 68°F (20°C) from 6:30 a.m. through 10:30 p.m. and 63°F at all other times averaged throughout all habitable rooms, bathrooms, and toilet rooms."
      (12)
      602.2 Residential occupancies. Dwellings shall be provided with heating facilities capable of maintaining a room temperature of 68°F (20°C) in all habitable rooms, bathrooms and toilet rooms. Cooking appliances shall not be used, nor shall portable unvented fuel-burning space heaters be used, as a means to provide required heating. The installation of one or more portable space heaters shall not be used to achieve compliance with this section.
      (13)   The first paragraph contained in Section 602.4 is amended in its entirety hereby; so that hereafter the said first paragraph contained in Section 602.4 shall be and read as follows:
      "602.4 Occupiable work spaces. Indoor occupiable work spaces shall be supplied with heat during the period from September 15th to May 1st to maintain a temperature of not less than 65°F (18°C) during the period the spaces are occupied."
      (14)   Chapter 8, entitled "Referenced standards", is amended to delete all reference to the "International Plumbing Code" and insert in place thereof the "Illinois Plumbing Code".
      (15)   Chapter 8, entitled "Referenced standards", is amended to delete all reference to the "International Zoning Code", and the "International Electrical Code".
      (16)   Chapter 8, entitled "Referenced standards", is amended to delete all reference to the "International Zoning Code", and the "International Electrical Code".
