§ 153.305. ACTION ON MINOR SUBDIVISION PLAT.
   (A)   Zoning, Planning and Appeals Commission Recommendation.  
      (1)   If, by reason of the general character or topography of the property to be subdivided, or of any lot to be created by such subdivision, it appears likely to the Village Engineer, the Director and the Chairman of the Zoning, Planning and Appeals Commission that a variation from the application of the Zoning Ordinance or a waiver of portions of the Building Code will be sought after approval of the plat for recording as submitted, then the Chairman of the Zoning, Planning and Appeals Commission shall reject the entire Plat of Subdivision, or may direct that such lots as to which it appears likely that a variation will be sought be excluded therefrom.
      (2)   Following the review of the plat of each such Minor Subdivision, the Director or the Chairman of the Zoning, Planning and Appeals Commission will make and send the President and Board of Trustees a written report containing the recommendation of the Zoning, Planning and Appeals Commission regarding the plat.
   (B)   President and Board of Trustees Consideration. Upon its receipt of a written recommendation from the Chairman of the Zoning, Planning and Appeals Commission, such Minor Subdivision plat shall be acted upon by the President and Board of Trustees.
