§ 32.60 ESTABLISHMENT.
   It is found and declared, pursuant to Cal. Health & Safety Code § 33101, that there is a need for the Redevelopment Agency created by Cal. Health & Safety Code § 33100 to function in the city and said agency is authorized to transact business and exercise its powers pursuant to and under the provisions of the Community Redevelopment Law, being Cal. Health & Safety Code §§ 3300 et seq.

§ 32.61 CITY COUNCIL TO SERVE AS REDEVELOPMENT AGENCY.
   (A)   The City Council, pursuant to Cal. Health & Safety Code § 33200, declares itself to be the Redevelopment Agency as provided in this sub-chapter, and that all rights, powers, duties, privileges and immunities vested by the Community Redevelop-ment Law in such agency shall be, and are, vested in this body. The City Council further finds that this action shall serve the public interest and promote the public safety and welfare in an effective manner.
   (B)   The City Clerk is authorized and directed to forward a certified copy of the ordinance codified in this section to the Secretary of State upon its adoption by the City Council.

PLANNING AGENCY
§ 32.70 CREATED; COMPOSITION.
   A City Planning Agency is created consisting of the City Planning Department, which shall be headed by the Planning Director, the City Planning Commission and the City Council.

§ 32.71 FUNCTIONS.
   The functions of the Planning Agency are as follows:
   (A)   It shall develop and maintain a general plan.
   (B)   It shall develop such specific plans as may be necessary or desirable.
   (C)   It shall periodically review the capital improvement program of the city.
   (D)   It shall perform such other functions as the Council shall provide and as are imposed upon it by law.

§ 32.72 POWERS.
   The Planning Agency shall have the powers necessary to enable it to fulfill and carry out its planning functions as provided by law.

PLANNING COMMISSION
§ 32.80 CREATED; COMPOSITION; APPOINTMENT.
   (A)   A City Planning Commission is created and established and will consist of five members appointed in conformance with this code.
   (B) The members of the Planning Commission will serve four (4) year terms at the pleasure of the Council, or until the successor has duly qualified and been appointed.
   (C) Commissioners appointed to fill vacancies arising during a term shall serve only for the remainder of the term of the Commissioner replaced.
   (D) Each of the members of the Planning Commission shall be and remain at all times during incumbency an actual resident of the City, and if at any time they cease to be an actual resident their office shall be vacated.

§ 32.81 ORGANIZATION.
   The Planning Commission is authorized to elect its own officers, schedule its meetings and adopt rules and by-laws for the transaction of its business.
