(a) No utility service provider, cable operator, or person shall construct, install, or place facilities in the rights-of-way without prior consent of the City, which consent shall be set forth in a rights-of-way construction permit issued by the City as provided in Section 919.07 of this chapter.
(b) A utility service provider, cable operator, or person seeking to repair, maintain, construct, install, or place facilities in the rights-of-way in a manner that requires cutting, breaking, opening, boring under, or altering street pavement, or digging, excavating, or performing any other work or activity which disturbs the existing surface or subsurface structure, composition, or soil compaction of the rights-of-way shall obtain, in addition to any permit required under paragraph (a) of this section, a street opening permit under Section 905.03 of the Codified Ordinances of the City.
