(a) When the tracks, including main tracks, spur tracks and side tracks of a railroad cross a street at a grade, the company operating the railway line shall cause its engines or cars to stop not nearer than ten or further than fifty feet from the crossing and before they start across such street shall cause a person in its employ to go ahead of the engineer or cars and see that the way is clear for passage and free from danger. No person in charge of such engine or cars shall cause them to proceed their passage over and across such street. However, this provision shall not apply to any crossing where the railroad company regularly maintains a flagman, gates, automatic alarm bell or other mechanical device in compliance with a requirement of the Public Utilities Commission or the statues of the State.
(b) Whoever violates this section is guilty of a misdemeanor of the third degree.
