A. No permit or certificate of public convenience and necessity shall be sold, transferred, assigned, mortgaged or otherwise conveyed without the approval of the Department of Finance and Management Services, and the sale, assignment, mortgaging, transfer or otherwise conveying any such certificate without the approval of the Department of Finance and Management Services first had and obtained shall revoke the certificate. Any successor, transferee or assignee shall comply with each requirement and condition of the permit or certificate.
B. Any aggrieved and interested party may appeal to the City Manager from a decision of the Department of Finance and Management Services made pursuant to this section, by filing a written notice of appeal with the Department of Finance and Management Services within ten (10) days of the challenged decision. The City Manager shall provide a hearing of such appeal, with notice and opportunity to present evidence, witnesses, and arguments. The formal rules of evidence shall not apply. The City Manager shall issue a written decision explaining the basis of his or her decision on the appeal and a copy of the written decision shall be mailed to the appellant.
