§ 12.1401   Cost-of-Living Adjustment.
   (a)   Adoption of Article 16.6 Alone. Pursuant to Article 16.6 of the County Employee’s Retirement Act of 1937, as amended, the Board of Supervisors adopts Article 16.6 alone as permitted by Government Code § 31879.
   (b)   Base Date. The base date for determining the percentage of cost-of-living increase shall be January 1, 1965.
   (c)   Increase in Cost of Living. Since the base date there has been an increase in the cost of living, justifying an increase in all retirement allowances to the extent of two percent.
   (d)   Cost-of-living Increase for All Retirement Allowances.
      (1)   A cost-of-living increase of two percent for all retirement allowances shall be effective, on a prospective basis only, on and after July 1, 1966, as provided in Government Code § 31877.
      (2)   An additional cost-of-living increase of two percent for all retirement allowances shall be effective, on a prospective basis only, on and after July 1, 1967, as provided in Government Code § 31877.
      (3)   An additional cost-of-living increase of three percent for all retirement allowances shall be effective, on a prospective basis only, on and after July 1, 1968, as provided in Government Code § 31877.
      (4)   An additional cost-of-living increase of three percent for retirement allowances of all members who are retired prior to July 1, 1969, shall be effective, on a prospective basis only, on and after July 1, 1969, as provided in Government Code § 31877.
      (5)   An additional cost-of-living increase of three percent for retirement allowances of all members who are retired prior to July 1, 1970, shall be effective, on a prospective basis only, on and after July 1, 1970, as provided in Government Code § 31877.
      (6)   An additional cost-of-living increase of three percent for retirement allowances of all members who are retired prior to July 1, 1971, shall be effective, on a prospective basis only, on and after July 1, 1971, as provided in Government Code § 31877.
      (7)   An additional cost-of-living increase of three percent for retirement allowances of all members who are retired prior to July 1, 1972, shall be effective on a prospective basis only, on and after July 1, 1972, as provided in Government Code § 31877.
      (8)   An additional cost-of-living increase of three percent for retirement allowances of all members who are retired prior to July 1, 1973, shall be effective, on a prospective basis only, on and after July 1, 1973, as provided in Government Code § 31877.
      (9)   An additional cost-of-living increase of three percent for retirement allowances of all members who are retired prior to July 1, 1974, shall be effective, on a prospective basis only, on and after July 1, 1974, as provided in Government Code § 31877.
      (10)   An additional cost-of-living increase of six percent for retirement allowances of all members who are retired prior to July 1, 1974, shall be effective, on a prospective basis only, on and after July 1, 1975, as provided in Government Code § 31877.
      (11)   An additional cost-of-living increase of three percent for retirement allowances of all members who are retired prior to July 1, 1975, shall be effective, on a prospective basis only, on and after July 1, 1976, as provided in Government Code § 31877.
      (12)   An additional cost-of-living increase of three percent for retirement allowances of all members who are retired prior to July 1, 1976, shall be effective, on a prospective basis only, on and after July 1, 1977, as provided in Government Code § 31877.
      (13)   An additional cost-of-living increase of four percent for retirement allowances of all members who are retired prior to July 1, 1977, and an additional cost-of-living increase of three percent for retirement allowances of all members who are retired prior to July 1, 1978, shall be effective, on a prospective basis only, on and after July 1, 1979, as provided in Government Code § 31877.
      (14)   An additional cost-of-living increase of five percent for retirement allowances of all members who are retired prior to July 1, 1979, shall be effective, on a prospective basis only, on and after July 1, 1980, as provided in Government Code § 31877.
      (15)   An additional cost-of-living increase of three percent for retirement allowances of all members who are retired prior to July 1, 1980, and an additional cost-of-living increase of five percent for retirement allowances of all members who are retired prior to November 27, 1970, shall be effective, on a prospective basis only, on and after July 1, 1981, as provided in Government Code § 31877.
      (16)   An additional cost-of-living increase of three percent for retirement allowances of all members who are retired prior to July 1, 1981, shall be effective, on a prospective basis only, on and after July 1, 1982, as provided in Government Code § 31877.
   (e)   The provisions of subdivisions 12.1401(d)(1), 12.1401(d)(2), and 12.1401(d)(3) shall not be applicable to any person who is not a member of the San Bernardino County Employees Retirement Association on or before August 18, 1975.
