§ 12.0509   Prisoner and Probationer Labor on Public Works.
   (a)   Prisoner. For the purposes of this Section, PRISONER means any person confined in the County Jail, industrial farm, road camp or similar restrictive County facility under a final judgment of imprisonment rendered in a criminal action or proceeding or as a condition of probation after suspension of imposition of a sentence or suspension of execution of a sentence.
   (b)   Probationer. For the purposes of this Section, PROBATIONER means any person under the charge of the court granting probation or the Probation Officer, who is required to work at public work pursuant to Penal Code § 1203.1.
   (c)   Labor. For the purposes of this Section, LABOR means any physical or mental activity or work directed toward the production of services or goods.
   (d)   Public Works or Ways. For the purposes of this Section, PUBLIC WORKS OR WAYS means any project or improvement constructed or maintained by the County of San Bernardino and districts governed by the Board of Supervisors and including, but not limited to, parks, buildings, paths, roads, streets, expressways, public road and flood-control rights of way or easements, reservoirs, canals, and sewers.
   (e)   Prisoners and Probationers Compelled to Labor. Any or all prisoners and probationers may be compelled to labor upon the public works or ways of the County of San Bernardino or to perform such other work for the County or districts governed by the Board of Supervisors as may be assigned. The assigned work shall be compulsory as an incident of incarceration for prisoners or an incident of probation for probationers. No prisoner or probationer engaged in labor pursuant to this section shall be considered a County employee, nor shall any such prisoner or probationer come within any of the provisions of the California workers’ compensation system or the Workmen’s Compensation Insurance and Safety Act of 1917.
   (f)   Direction of Labor. Work assignments of prisoners provided for in this Section shall be made by the Sheriff, and the work shall be performed under the direction of a responsible person designated by the Sheriff or by work crew supervisors pursuant to § 12.1101 of this Code. Work assignments of probationers provided for in this Section shall be made by the court granting probation or the Probation Officer, and shall be performed under the direction of a responsible person designated by the court granting probation or the Probation Officer.
