§ 153.093 SANITARY SEWER IMPROVEMENTS.
   The following requirements shall govern sanitary sewage disposal.
   (A)   All laws, regulations, and guidelines set forth by the County Health Department at the time of this enactment shall be followed, and any future laws, regulations, and guidelines deemed necessary for the protection of public health shall be followed as they become effective.
   (B)   Where an adequate public sanitary sewer system, in the determination of the Village Planning Commission, is reasonably accessible, public sanitary sewers shall be installed to adequately serve all lots, including lateral connections to the public system. Public sewer system extensions shall meet the requirements of the State Department of Health and village standards. Where a public sanitary sewer system is not reasonably accessible or required, the subdivider may provide a package plant for the group; provided that such package plants are installed in accordance with State and County Board of Health requirements. Such plants shall be operated and maintained by the county government as soon as the plant is operable if located outside the corporation. Costs of operation shall be paid by the developer until the plant becomes self-supporting. During the transitional period, the developer will be credited with revenues received from subscribers. All costs of maintenance and operation after this transition period will be paid by the subscribers with rates set at a level to ensure sufficient revenues to cover these costs.
   (C)   (1)   The number of lots in a subdivision without a central sewage disposal plant shall be governed by the following conditions:
         (a)   The soil type in the subdivision;
         (b)   The existing drainage conditions of the soil;
         (c)   The existing surface drainage;
         (d)   The absorptive ability of the soil; and
         (e)   The possible installation of artificial means of subsurface drainage.
      (2)   In areas with severe conditions for on-site disposal of sewage, the following types of installations may be required: septic tanks in tandem with two full size leaching fields determined by the absorptive ability of the soil and larger lots. The two leaching fields will be used in rotation. One field will be used for one year. Then the sewage effluent shall be diverted from the first field to the second field for a year.
   (D)   Where the installation of individual disposal systems is considered, the suitability of the soil for individual systems, the absorptive ability of the soil, surface drainage, groundwater level, possibility of subsurface drainage, and topography shall be the criteria for determining whether the installation of individual systems is permissible. Criteria shall be in accordance with the requirements of the County Board of Health and the requirements of the State Department of Health.
   (E)   Where on-site sewage disposal facilities are to be used, each lot so served shall be of a size and shape to accommodate the necessary length of the field at a safe distance from, and at a lower elevation then, the proposed building(s). Such lot size and shape shall conform to the requirements of the zoning district in which they are located. If no zoning is in effect, the standards set forth in § 153.063(C) of these regulations shall be met.
   (F)   Percolation tests may be required when deemed necessary. All percolation tests shall be performed in accordance with the requirements of the Village Planning Commission and the County Board of Health.
