(A) Prohibited use. It shall be unlawful for any person to use a skateboard or scooter. This shall include motorized scooters which are not licensed by the state under the State Vehicle Code, being 625 ILCS 5/1-100 et seq. on any public street or public sidewalk in the village, unless expressly authorized by the ordinances of this village, or by the Chief of Police.
(B) Exceptions. This section shall not apply to those areas in public parks designated for use by skateboarders, or in-line skaters; however, this exception shall not apply to those areas of public parks which are designated as benches or railings, or curbing.
(C) Forfeiture. Upon receipt of a notice of violation, and forfeiture of the skateboard or scooter, the violator shall have ten days to appeal to the village for a hearing, and full review of the forfeiture. Upon the filing of a notice, the violator must file a deposit in an amount as set forth in § 35.02 for the return of the skateboard or scooter pending hearing.
(D) Remedies not exclusive. Nothing herein shall be deemed to be the exclusive remedy in the village, and all such other penalties as are allowed under this code, and the statutes of the state shall apply.
