§ 91.02 NOTICE TO ABATE NUISANCES.
   In order to carry out the provisions of § 91.01, it shall be the duty of the Chief of Police to serve notice in writing upon the owner, occupant, or agent of any premises upon which a nuisance may be found requiring him or her to abate the same within a reasonable time. Upon proper cause, such Chief of Police shall at all times comply with the BOCA Basic Housing Property Maintenance Code in accordance with § 150.01. If such owner, occupant, or agent shall neglect or refuse to comply with the requirements of such order within the time specified, he or she shall be subject to the appropriate fine of § 10.99 for every such violation. It shall be the duty of the Chief of Police to proceed at once upon the expiration of the time specified in the notice, to cause such nuisance to be abated and the expense of abatement of all nuisances shall be collected by suit in the name of the village and against the owner or the occupant of the premises or author of said nuisance, as the case of money paid at his or her request.
