§ 11.18 DEPARTMENT OF POLICE; POLICE RESERVE.
   (A)   Department of Police.
      (1)   The Police Department shall be headed by the Chief of Police who shall be charged with the enforcement of law and order and the protection of life and property within the jurisdiction of the city.
      (2)   The Police Department shall be structured into the following major divisions.
         (a)   Patrol Division. The Patrol Division shall be supervised by a command officer who, under the direct supervision of the Chief of Police, shall be responsible for sustained and intensive preventive patrol and shall be charged with primary responsibility for the Department’s effort to prevent crime and delinquency, protect life and property, and preserve the public peace.
         (b)   Investigation Division. The Investigation Division shall be supervised by a command officer who, under the direct supervision of the Chief of Police, shall be responsible for the in-depth follow-up investigation of crimes, the recovery of stolen property, and the preparation of cases for court presentation.
      (3)   Functional sections, special staff sections or units, and auxiliary responsibilities will be assigned by order of the Chief of Police in accordance with the operational needs and authorized personnel strength of the Department. Administrative support, communications equipment, records and identification, and automated data processing shall be performed by other departmental personnel over whom direct supervision shall be temporarily transferred from their respective departments to the Chief of Police.
      (4)   The Chief of Police shall assign sworn officers to the Patrol and Investigation Divisions of the Department and shall make such other assignments deemed necessary.
   (B)   Police Reserve.
      (1)   A Police Reserve Unit, hereinafter called Reserve, is hereby established as a voluntary organization to serve gratuitously, composed of persons appointed by the Chief of Police hereinafter called the Chief.
      (2)   The Police Chief shall have operational authority and control over the Reserve. The Chief may appoint as a member thereof any person determined to be qualified and may reject any application for membership. The Chief may provide for the training of candidates for membership and for the further training of members. Membership is open to qualified persons not less 18 years of age.
      (3)   No person shall become a member of the Reserve until the person has taken the training and is able to meet all other requirements prescribed by the Chief. When so qualified and selected, the person shall then be sworn in by the Chief or by the Chief’s representative as a member of the Reserve.
      (4)   The duties of the Reserve shall include assisting the regular members of the Police Department of this city in the enforcement of law and the maintenance of peace and order whenever and wherever its services are required. The Chief may, by order, establish rules and regulations to govern the Reserve, including the fixing of specific duties of its members and the providing for the maintenance of discipline. The Chief may change such orders from time to time.
      (5)   An identification card, badge, and cap, and such other insignia or evidence of identification as the Chief may prescribe shall be issued to each member who must carry the card at all times. Each member must surrender all issued city property upon the termination of his or her membership.
      (6)   The membership of any person in the Reserve may be terminated by the Chief at any time, and such member may resign from the Reserve upon notifying the Chief in writing of the resignation; provided, however, that the personnel regulations of the City Manager applicable to full- time, regular city employees shall not be applicable to the Reserve.
      (7)   No member of the Reserve shall carry any firearm until the member has qualified for and received a gun permit and only in cases of extreme emergency and necessity as determined by the Chief and the City Manager.
      (8)   A member of the Reserve, when on duty as assigned by the Chief, shall have the authority to direct traffic and shall have such other duties as the Chief may direct.
      (9)   The Chief may, by order, diminish or expand the membership of the Reserve.
      (10)   The badge and cap may be worn only while on duty as assigned by the Chief.
      (11)   Each member of the Reserve while acting under the direction of the Chief during a regular assigned tour of duty is an employee of the city for worker’s disability compensation purposes only and is eligible, but only to the extent provided for hereinafter, to receive worker’s disability compensation benefits from the city in accordance with the provisions of the Worker’s Disability Compensation Law of the state. If any member sustains an illness or injury otherwise covered by the Worker’s Disability Compensation Law, which is not caused, aggravated, accelerated, or contributed to by alcoholism or the member’s willful misconduct, or which is not intentionally self-inflicted, and which, with or without negligence, is proximately caused by and arises out of and in the course of the performance of duties while acting under the direction of the Chief during a regular assigned tour of duty, for the purpose of computing the benefits to which such member, or the member’s dependents within the meaning of the provisions of the Worker’s Disability Compensation Law, may be entitled pursuant to the Worker’s Disability Compensation Law, a member of the reserve will receive benefits based upon the member’s average weekly earnings, inclusive of all fringe benefits and should be taken to be the usual wage for similar services if these services are rendered by paid employees in accordance with the Worker’s Disability Compensation Act, Public 317 of 1969.
