(A) Title. This section shall be known and cited as the “City of Saginaw Public Nudity Ordinance”.
(B) Purpose. The purpose of this section is to prohibit public nudity within the city.
(C) Regulations. No person shall:
(1) Knowingly or intentionally provide for and/or promote or participate in the display, in a public place located within the city, of his or her genitals or anus unless a fully opaque material covers his or her genitals and/or anus, or of a female individual’s breast with less than a fully opaque covering of the nipple and areola;
(2) Knowingly or intentionally provide for and/or promote or participate in the display, in a public place located within the city, of any individual’s genitals or anus unless a fully opaque material covers his or her genitals and/or anus, or of a female individual’s breast with less than a fully opaque covering of the nipple or areola; and
(3) For purposes of division (C)(2) above, providing for, promoting, or participating in the display in a public place located within the city of any individual’s genitals or anus unless a fully opaque material covers his or her genitals and/or anus, or a female individual’s breast with less than a fully opaque covering of the nipple and areola, includes public displays for money or items of value or promise of the same by any person, firm, or other entity including, but not limited to, payment or promise of payment of an admission fee.
(D) Exemptions. The following actions or materials shall be exempt from application of this section:
(1) A woman’s breastfeeding of a baby whether or not the nipple or areola is exposed during or incidental to the feeding;
(2) Material as defined in Public Act 343 of 1984, being M.C.L. § 752.362; and
(3) Sexually explicit visual material as defined in Public Act 33 of 1978, being M.C.L. § 722.673.
