§ 96.038 CURBS UNDER CONSTRUCTION.
   (A)   Leaving voids in curbs under construction. The City Engineer shall, upon written request of the property owner, authorize the leaving of voids in curbs under construction in conformity with the provisions of this subchapter. In the absence of such written request, the City Engineer may order such voids as he or she finds necessary to serve existing driveways.
   (B)   New curb cuts; paving between curb and sidewalk required. On and after February 1, 1958, any person obtaining a permit for a curb cut in an existing curb or for whose property a void is provided in a new curb pursuant to division (A) above shall cause the area between the curb cut or void and nearer sidewalk line to be paved with concrete or asphalt in accordance with regulations therefor established by the City Manager. In the event such area is not paved as herein required, the City Engineer shall cause the same to be done, giving the same notice required for the repair of defective sidewalks and following the procedure now or hereafter established for such sidewalk repair, including the assessing of the cost of paving such area against the premises and the owner thereof.
