(A) Establishment. In recognition of the fact that it is in the best interest of the public to halt property value deterioration within the downtown business district, to eliminate the causes of such deterioration, and to promote economic growth within the downtown business district, a Downtown Development Authority is hereby established pursuant to the Downtown Development Authority Act, Public Act 197 of 1975, being M.C.L. §§ 125.1651 et seq., to be known as the City of Saginaw Downtown Development Authority.
(B) Powers, duties, procedures. The City of Saginaw Downtown Development Authority shall have all the powers and duties prescribed by the Downtown Development Authority Act, Public Act 197 of 1975, being M.C.L. §§ 125.1651 et seq. The Authority shall provide the City Planning Commission all reports and studies regarding the formulation and implementation of project development plans. The Authority shall secure the approval of development plans from the Planning Commission and City Council prior to the implementation of any plans thereof.
(C) Boundaries. The Authority shall exercise its powers within the following described area within the City of Saginaw, County of Saginaw, State of Michigan:
Beginning at the northwesterly corner of Millard St., and S. Park Ave., thence southeasterly along the western line of S. Park Ave. to the southerly line of Burt St. to the easterly line of S. Fourth St., thence northwesterly along the easterly line of S. Jefferson Ave. to the southerly line of Holden St., thence easterly along the southerly line of Holden St. to the easterly line of Owen St., thence northeasterly along the easterly line of Owen St. to the southerly line of Meredith St. thence easterly along the southerly line of Meredith St. to the easterly line of Howard St., thence northeasterly along the easterly line of Howard St. to the northerly line of Hoyt St., thence northwesterly along the northerly line of Hoyt St. to the easterly line of Owen St., thence northeasterly along the easterly line of Owen St. to the northerly line of Millard St., thence northeasterly along the northerly line of Millard St. to the westerly line of S. Park St. which is the point of beginning. Excepting from the above description Lot 1, Joseph Campau Farm lying west of Michigan Ave. and south of Houghton Ave., Lots 2, 3, and 4, Joseph Campau Farm lying west of Michigan Ave. also known as Bliss Park.
(D) Taxing power. The Authority may, with the approval of the City Council, levy an ad valorem tax on the real and tangible personal property not exempt by law and as finally equalized in the Downtown Development Authority district described in division (C) above.
(E) Director; bond. Pursuant to the Downtown Development Authority Act, Public Act 197 of 1975, being M.C.L. § 125.1655, as amended, the Director of the City of Saginaw Downtown Development Authority shall, before entering upon or performing any of the duties of the office, post a bond in the penal sum of $20,000 payable to the Authority for the use and benefit of the Authority, approved by the Board of the Authority, and filed with the City Clerk. The premium on the bond shall be deemed an operating expense of the Authority, payable from funds available to the Authority for expenses of operation.
(F) Bylaws. The Board of the Authority shall develop and approve bylaws for its operation. The bylaws and any amendments thereto shall be filed with the City Council and if the City Council takes no action on said bylaws or amendments thereto within 30 days after filing same, said bylaws or amendments thereto shall be deemed approved.
