§ 71.01 NOISE AND SMOKE.
   (A)   No person in charge or control of any vehicle on any street, alley, or private property shall make with such vehicle or any device connected therewith any noise so excessive as to annoy the public. Violation of this provision shall be deemed a Class C civil infraction and shall be punishable as provided in Ch. 37 of this code of ordinances.
   (B)   No person shall use any sound amplifying device, recorded music, or radio in or from any vehicle on any street for the purpose of attracting the attention of persons to the sounds issuing therefrom excepting in vehicles and by devices officially used by governmental units, and excepting uses authorized by § 94.045 through 94.047. Violation of this provision shall be deemed a Class C civil infraction and shall be punishable as provided in Ch. 37 of this code of ordinances.
   (C)   Every motor vehicle, including every motorcycle or motor-driven cycle, shall at all times be equipped with a muffler in good working order and in constant operation to prevent excessive or unusual noise and annoying smoke. A person shall not remove, destroy, or damage any of the baffles contained in the muffler, nor shall a person use a muffler cutout, bypass, or similar device upon a motorcycle or motor-driven cycle on a highway or street. Violation of this provision shall be deemed a civil infraction and shall be punishable as provided in § 70.99(A).
   (D)   The engine and power mechanism of every motor vehicle shall be so equipped and adjusted as to prevent the escape of excessive fumes or smoke. Violation of this provision shall be deemed a civil infraction and shall be punishable as provided in § 70.99(A).
   (E)   Every motor vehicle shall at all times be equipped with a properly operating exhaust system which shall include a tailpipe and resonator on any vehicle where the original design included a tailpipe and resonator. Violation of this provision shall be deemed a civil infraction and shall be punishable as provided in § 70.99(A).
