§ 51.077 USER CHARGES AND FEES.
   (A)   It is the purpose of this section to provide for the recovery of costs from users of the city’s POTW for the operation of the pretreatment program established in §§ 51.020 through 51.053. The applicable charges or fees shall be set forth in a schedule of charges and fees and shall be sufficient to meet costs of operation of the pretreatment program or as provided by law.
   (B)   (1)   The City Manager shall adopt charges and fees by rule and regulation, subject to the approval by the City Council; such charges and fees shall include:
         (a)   Reimbursement of costs of setting up and operating the wastewater treatment and pretreatment programs;
         (b)   Costs for monitoring, sampling, analysis, inspections, and surveillance procedures;
         (c)   Costs for reviewing accidental discharge procedures and construction;
         (d)   A fee for filing appeals;
         (e)   Costs of consistent removal (by the POTW) of pollutants otherwise subject to federal pretreatment standards; and
         (f)   Other fees and charges as the City Manager may deem appropriate to carry out the requirements of this subchapter and §§ 51.020 through 51.053.
      (2)   The fees and charges established by the City Manager shall be based upon the reasonable cost to the city to regulate or perform the action.
