§ 12.036 HOUSING COMMISSION.
   (A)   Creation and membership.
      (1)   Pursuant to Public Act 18 of 1933 (Extra Session), being M.C.L. §§ 125.651 et seq., as amended (“Act 18”), a commission is hereby created in and for the city to be known as the “Saginaw Housing Commission”.
      (2)   The City Mayor is hereby directed to appoint the five members of the said Housing Commission. Said members may be removed with or without cause by City Council upon recommendation of the Mayor.
   (B)   Powers and duties.
      (1)   The Saginaw Housing Commission shall have all the powers and duties vested or permitted to be vested in housing commissions by Public Act 18 of 1933 (Extra Session), being M.C.L. §§ 125.651 et seq., as heretofore or hereinafter amended, and any laws heretofore or hereinafter enacted which are supplemental thereto; except for the following enumerated powers and duties reserved to the City Council.
      (2)   The Saginaw Housing Commission shall select and appoint such officers or employees as it shall deem necessary for the proper exercise of its powers, functions, and duties, but their compensation shall be determined by the salary ranges and/or classifications set by City Council.
      (3)   The Saginaw Housing Commission shall obtain City Council approval prior to entering or accepting any grant agreements in the name of the Saginaw Housing Commission.
      (4)   The Saginaw Housing Commission shall report in writing on an annual basis on grant project activities, audit and operations. This report shall be made within 90 days of the Saginaw Housing Commission’s fiscal year end.
      (5)   (a)   The Saginaw Housing Commission shall pay an annual service fee in lieu of all taxes with respect to projects or facilities of the Commission or qualified entities.
         (b)   The fee shall be computed as total annual shelter rent minus utilities not to exceed 10% of the net annual shelter rent obtained from the project or facilities.
         (c)   The City Manager shall annually determine the amount of fee due.
   (C)   Additional powers and duties granted by City Council. Public Act 18 of 1933 (Extra Session), being M.C.L. §§ 125.651 et seq. provides the City Council may grant the following enumerated powers and responsibilities to the Saginaw Housing Commission.
      (1)   All existing deeds, mortgages, contracts, leases, purchases, or other agreements regarding real property including agreements to acquire or dispose of real property shall be assigned to the Saginaw Housing Commission. All future deeds, mortgages, contracts, leases, purchases, or other agreements regarding the real property, including agreements to acquire or dispose of real property, shall be approved by and executed in the name of the Saginaw Housing Commission.
      (2)   The Saginaw Housing Commission shall have the power to act as a borrower for purposes of issuing bonds or notes under M.C.L. §§ 125.651 et seq.
