(A) Creation and membership.
(1) The Board of Fire Code Appeals is hereby created. The members of the Board of Building Appeals shall also serve as members of the Board of Fire Code Appeals. In addition, the Mayor, with Council approval, shall appoint an experienced fire code official from another jurisdiction to serve as an additional member of the Board.
(2) The Fire Chief or an officer of the Fire Department designated by the Fire Chief shall serve as Secretary of the Board but shall not be a member thereof.
(3) The Board shall select one of its members as Chairperson and another as Vice Chairperson to serve in the absence of the Chairperson. The Chairperson or the Secretary shall call meetings of the Board as required to perform its duties.
(B) Powers and duties. The Board shall determine the suitability of alternate materials and types of construction and provide reasonable interpretations of the provisions of the adopted Fire Code. The Board shall adopt reasonable rules and regulations for conducting its investigations and shall render all decisions and findings in writing to the Fire Chief with a duplicate copy to the appellant and may recommend to the Council such new legislation as is consistent with the adopted Fire Code.
