§ 17.02 CREATION AND DUTIES OF CITY MERS PENSION BOARD.
   (A)   The city shall create a City MERS Pension Board, which shall be a recommending body to City Council overseeing this pension. The Board’s responsibilities shall include, but not to be limited to, review and recommend changes to this pension chapter for Council approval, and review the city’s annual actuarial valuation of the MERS Pension System. The Board shall consist of seven members, which are as follows:
      (1)   The Mayor by virtue of his or her office;
      (2)   The City Manager by virtue of his or her office;
      (3)   A department head appointed by the City Manager;
      (4)   A Service Employees International Union (SEIU) hourly member elected by the SEIU hourly employees;
      (5)   A Service Employees International Union (SEIU) salaried member elected by the SEIU salaried employees;
      (6)   An American Federation of State, County, and Municipal Employees (AFSCME) member elected by the AFSCME employees; and
      (7)   A MERS retiree member selected by a majority vote of the other Board members.
   (B)   Board members shall hold office for a term of three years; such term shall expire on June 30 of each year. Members shall continue in office until a new member succeeds them. Within ten days of appointment, the City Clerk shall administer the oath of office.
   (C)   Each Board member shall be entitled to one vote on each question before the Board. Four Board members shall constitute a quorum and a majority vote of the Board shall be necessary for a decision by the Board.
   (D)   The SEIU, AFSCME, and retiree members may elect an alternate for each seat held to serve in their absence. The City Manager shall have the Deputy City Manager serve as his or her designee in his or her absence. The alternate member(s), only in the absence of their respective elected Board member, shall be entitled to one vote on each question before the Board and be counted for purposes of constituting a Board quorum. An alternate member shall not be entitled to serve as a retirement system member.
   (E)   The Board shall meet regularly on an annual basis or at any time when there is a need for Board action. All meetings of the Board shall be public. There shall be records kept of each meeting.
   (F)   The Board shall select from its members a Chairperson. The City Attorney shall be legal advisor to the Board. The City Manager shall designate a city officer to serve as secretary and administrative officer to the Board.
