Any allowance payable to, or on account of, a member of this plan by reason of any bodily injury or physical illness caused by or incurred in performance of his or her duty, or payable on account of a member's death by reason of any injury received in, or illness caused by, the performance of his or her duty, shall not be cumulative with benefits under Division 4 of the Labor Code of the state of California awarded to, or on account of, a member as a result of the same injury, illness or death. Any such allowance shall be reduced, in the manner fixed by the council, by the amount of benefits, other than medical benefits, payable to or on account of the member under Division 4 of the Labor Code of the state of California; provided, however, that in no event shall the annuity portion of any such allowance be reduced by the amount of benefits payable to, or on account of, the member under Division 4 of the Labor Code of the state of California.
