2.124.700   Determination of continuance of disability.
   The retirement system manager may require any member of this plan retired on a disability retirement and under the applicable age of voluntary service retirement to undergo medical examinations from time to time without cost to the member. The examinations shall be made by a physician or surgeon appointed by the manager at the place of residence of the member or other place mutually agreed upon. Upon the basis of such examinations, the manager shall determine whether the member is still physically or mentally incapacitated for service with the city in the position held by him or her when retired for disability.
   If the retirement system manager finds, after considering medical advice, that a member of this plan retired on a disability retirement is not physically or mentally incapacitated for service in the office or department of the city where he or she was employed and in the position held by him or her when retired for disability, he or she shall be eligible for reinstatement in the city service and his or her retirement allowance shall be canceled forthwith upon reinstatement. If a retired member eligible for reinstatement does not reenter city employment within thirty (30) days of the date when reemployment is made available to him or her, his or her retirement allowance shall be permanently canceled. The civil service board, notwithstanding any other provision of the Charter to the contrary, shall adopt rules and regulations establishing reasonable procedures which permit the reinstatement of such member.
