2.16.090   Disqualification of former officers and employees in matters connected with former official responsibilities.
   A.   No former officer or employee of the city shall, within one year after his or her city employment has ceased, appear personally before the city council or any department, board or commission or committee of the city as an agent for anyone other than the city in connection with any proceeding, application, request for ruling or other determination, contract, claim, controversy or other matter which was under his or her official responsibility as an officer or employee of the city at any time within one year prior to the termination of such responsibility.
   B.   As used herein, the phrase "official responsibility" means the authority, whether intermediate or final, whether exercisable alone or with others and whether exercisable personally or through subordinates to approve, disapprove or make recommendations for approval or disapproval to the city council, any city board or commission, or any city department or division head in connection with any proceeding, application, request for ruling or other determination, contract, claim, controversy or other matter before the city.
   C.   As used herein, "officer" means any department head, assistant department head and any division head or assistant division head.
   D.   As used herein, "employee" means any person whose position is included in the classified service, and any employee whose position is by resolution designated exempt from the classified service and which position is by resolution also designated as "management." (Prior code § 53.02.010)
